"Regulatory free pass" if the blockchain has a huge ecosystem of dApps built on it. Except for other factors such as "proof of work," "VCs," and a big number of billionaire investors, I think this is the main point the Cardano founder is telling Ripple that could have avoided that lawsuit.
How about Hive? Though it remains a question whether a strong regulatory hand can really touch a decentralized entity like Hive, at least we already have hundreds of dApps built on the blockchain. The community has just to grow them to thousands.
